FIA advisor Alan Donnelly, who represents Max Mosley at most Formula 1 events, has obtained permission to proceed to a summary judgement for libel against Business F1 magazine and Tom Rubython.
His Honour Judge Previte ruled that there was no realistic prospect of defending the claim and he refused the defendants permission to amend their defence and ruled that an article published in the January 2005 edition of Business F1 Magazine of which Mr Donnelly complained is plainly defamatory and said that the only issues remaining to be decided are meaning, damages and circulation and when a hearing to determine damages will be fixed. The judge refused the defendants permission to appeal and awarded Donnelly costs.
